Market Chatter: McKesson, AmerisourceBergen's Joint Motion to Dismiss Antitrust Case Granted by Pennsylvania Judge
Feb 6, 2025 12:01 PM

02:44 PM EST, 02/06/2025 (MT Newswires) -- McKesson (MCK) and AmerisourceBergen's (ABC) joint motion to dismiss an antitrust case filed by reseller plaintiffs for allegedly colluding to inflate prices of generic pharmaceutical products was granted by Judge Cynthia Rufe of the US District Court for the Eastern District of Pennsylvania, Bloomberg reported, citing the order.

The plaintiffs "failed to sufficiently allege the existence of an explicit agreement" between the distributors and manufacturers to manipulate prices by allocating market share of generic drugs, the judge reportedly said.

The plaintiffs include independent pharmacies and a hospital, according to the report late Wednesday.

The resellers' complaint lacked specific evidence of the distributor being aware of any agreement between manufacturers, and the cited conversations were insufficient to infer distributor knowledge and participation in an illegal agreement, the judge added.

McKesson and AmerisourceBergen did not immediately respond to MT Newswires' requests for comment.
