03:14 PM EDT, 09/26/2024 (MT Newswires) -- A federal court in Minnesota denied Target's ( TGT ) attempt to dismiss a consumer class action that claims the retailer's "Target Clean" labeling misled shoppers, according to a court filing.
The lawsuit, brought by a group of consumers, centers on Target's ( TGT ) "Target Clean" program, which the company launched in 2019 to help consumers identify products it claimed were free from certain harmful chemicals.
However, plaintiffs allege that some items with the "clean" label still contained unwanted ingredients, such as propylparaben.
In filing a motion to dismiss the lawsuit, Target ( TGT ) argued that no reasonable consumer would be misled by its labeling and that the term "clean" lacked a widely-accepted meaning.
"Although the court acknowledges that some of Target's ( TGT ) arguments present a close call, the court concludes that, at this stage and in light of the detailed allegations in the complaint, dismissal is not appropriate," US District Judge Katherine M. Menendez ruled Wednesday in allowing the lawsuit to continue.
