03:01 PM EDT, 06/10/2024 (MT Newswires) -- Amazon.com ( AMZN ) was granted a dismissal to a proposed class action, by a federal judge in Seattle, that alleged failure to meet "guaranteed delivery" for some purchases.
US District Judge Kymberly Evanson on Friday ruled to dismiss the case saying that the customer failed to demonstrate how Amazon's ( AMZN ) delivery practices violate Washington's consumer protection law.
"It is not unfair or deceptive for Amazon ( AMZN ) to fail to abide by promises it did not make," Evanson wrote.
She, however, allowed the Amazon ( AMZN ) customer to submit an amended complaint by July 8.
Amazon.com ( AMZN ) did not immediately respond to MT Newswires' request for comment. Its shares were up 1% in recent Monday trading.
