08:54 AM EDT, 03/27/2024 (MT Newswires) -- Amazon.com's ( AMZN ) request to suspend its obligation to make an advertisement repository available to the public was rejected by the Court of Justice of the European Union.
"The interests defended by the EU legislature prevail... over Amazon's ( AMZN ) material interests, with the result that the balancing of interests weighs in favor of rejecting the request for suspension," the court said Wednesday.
On April 23, the European Commission designated Amazon Store as a "very large platform" that has an obligation to make publicly available a repository that contains detailed information on the company's online advertising.
"We are disappointed with this decision, and maintain that Amazon ( AMZN ) doesn't fit the description of a 'Very Large Online Platform' under the [Digital Services Act], and should not be designated as such," Amazon ( AMZN ) told MT Newswires. "Customer safety is a top priority for us at Amazon ( AMZN ), and we continue to work closely with the EC with regard to our obligations under the DSA."
In Poland, Office of Competition and Consumer Protection President Tomasz Chrostny imposed a fine of about 31.9 million Polish zlotys ($8.0 million) for allegedly misleading consumers.
"Consumers were misled by false information about product availability and delivery times," the consumer watchdog said Wednesday. "This is an illegal practice of dark patterns."
Amazon ( AMZN ) told MT Newswires that it will appeal the decision.
