09:06 AM EDT, 04/12/2024 (MT Newswires) -- Apple's ( AAPL ) appeal to throw out a UK mass lawsuit, which accuses the iPhone maker of charging third-party developers "excessive and unfair" commissions, was rejected, according to the Competition Appeal Tribunal ruling published Friday.
In its unanimous decision, the Tribunal said the case has a realistic prospect of establishing that the complainant's claim is governed by UK law and falls within the territorial scope of the Competition Act 1998 and Treaty for the Functioning of the European Union.
The Tribunal also ruled that it is the "appropriate forum for the trial" of the claims concerning the commission charged on transactions through non-UK storefronts.
"In the Tribunal's view, there was no breach of the duty of full and frank disclosure on the [proposed class representative's] part," the tribunal added.
Apple ( AAPL ) did not immediately respond to MT Newswires' request for comment.
