11:16 AM EDT, 09/08/2025 (MT Newswires) -- Birchtech ( BCHT ) rose 4% on last look after saying it dropped all claims against two affiliated coal-fired power utilities following non-exclusive agreements with them.
The two companies had been defendants in Birchtech's ( BCHT ) 2024 lawsuit over intellectual property tied to its mercury emissions reduction technologies.
The agreements include a one-time license fee and give Birchtech ( BCHT ) a five-year right to bid on certain product supply contracts for mercury emissions capture at the utilities' plants. Specific terms were not disclosed due to confidentiality agreements and ongoing litigation, the company said.
Claims will continue against the remaining non-affiliated defendants in the Iowa lawsuit.
Since 2019, Birchtech ( BCHT ) has signed 12 license and supply agreements with coal-fired utilities, including eight previously named as defendants in the 2019 and 2024-2025 lawsuits, the company said.
"Following our success in the 2024 jury trial, our outreach across the coal-fired power industry has been effective largely due to our "business-first" approach. Since 2019, our objective has been focused on building solid, strong relationships with these utilities who are already benefitting from our clean air technologies," said chief executive Richard MacPherson.
"To date, with the license and supply bidding agreements announced today, we have established business relationships with four utilities from the consolidated lawsuits currently pending in Iowa originally commenced in 2024."
Birchtech ( BCHT ) is up $0.04, to $1.04, on the Toronto Stock Exchange.
