Birchtech Jumps 10%, Says Remaining Attempts to Challenge Patents Under IPR Petition Have Ended

10:56 AM EDT, 06/03/2026 (MT Newswires) -- Birchtech ( BCHT ) , up 10.4% on last look, Wednesday said that termination requests for all remaining inter-parties review (IPR) petitions filed against its core patents have been filed.

The remaining entities involved in IPR proceedings have resolved their disputes with Birchtech ( BCHT ) and are ending all previously filed third-party challenges to the validity of Birchtech's ( BCHT ) patented SEA mercury emissions removal technology, a statement added.

No other active IPR proceedings remain.

Birchtech's ( BCHT ) patented SEA sorbent technology captures mercury emissions from coal-fired power plant. Since filing its first patent infringement claim in 2019, the company has worked to protect its intellectual property portfolio, it said.

"Since 2019, our patent protection strategy has been strong, highly enforceable and validated at the federal level," said chief executive Richard MacPherson.

"With these final challenges now resolved, that chapter is fully closed. The same expertise and intellectual property discipline that protected our Clean Air business is now being applied to Water. We are rapidly entering the massive, North American water treatment market with disruptive technologies and early commercial traction, a stable revenue foundation from our air business and a bolstered balance sheet."

Birchtech ( BCHT ) shares were last seen up $0.27, to $2.86, on the Toronto Stock Exchange.
