05:14 PM EDT, 06/04/2025 (MT Newswires) -- Boeing ( BA ) said Wednesday that it signed a non-prosecution agreement with the US Department of Justice on May 29, settling matters related to two fatal 737 MAX crashes in 2018 and 2019.
Under the NPA, which resolves matters relating to DoJ's determination that the company did not fulfill its obligations under the deferred prosecution agreement dated Jan. 6, 2021, the company is subject to a $487.2 million overall criminal monetary penalty.
The company said it had already paid $243.6 million pursuant to the deferred prosecution agreement. The remaining $243.6 million was included in amounts expensed by the company in 2024 under the proposed plea agreement between the company and the DoJ filed with the US District Court for the Northern District of Texas on July 24, 2024.
On top of it, the company is required to pay $444.5 million in additional compensation to the beneficiaries of people who died in the Lion Air Flight 610 and Ethiopian Airlines Flight 302 accidents. It is also required to invest $455 million in its compliance, safety, and quality programs through the end of the term of the NPA and to retain an independent compliance consultant to assess progress regarding remediation and implementation of the compliance measures, among other things.
The NPA has a term of two years from the date on which the company retains the independent compliance consultant, unless extended or terminated earlier, the company said.
