Federal Appeals Court to Reconsider Airline Fee Disclosure Rule

07:04 AM EDT, 10/03/2025 (MT Newswires) -- A federal appeals court said Thursday it has agreed to revisit its earlier ruling that allowed the US Department of Transportation to require airlines to clearly disclose extra fees, such as those for baggage and seat selection the time of booking.

Major carriers, including Alaska Airlines (ALK), American Airlines ( AAL ) , Delta Air Lines ( DAL ) , JetBlue ( JBLU ) , and United Airlines (UAL), are challenging the rule introduced in April 2024, arguing it exceeds the agency's legal authority and would be expensive to implement.

In a brief order, the 5th US Circuit Court of Appeals in New Orleans said all 17 of its judges will rehear the case "en banc."

A hearing date hasn't been set.

Reuters reported that the Transportation Department opposed the rehearing request, maintaining that the court acted appropriately in sending the rule back for further review.

The airlines did not immediately respond to a request for comment from MT Newswires.
