10:09 AM EDT, 03/19/2024 (MT Newswires) -- Ferrari ( RACE ) faces a proposed class-action lawsuit initiated by California customer Iliya Nechev for allegedly failing to address a "life-threatening" brake defect in some of its luxury sports cars.
"Defendants have not informed owners of the full extent of the Brake Defect, only remedied one failure mode, and continue to sell [or benefit from the sale] of thousands of cars containing this life-threatening defect," alleges the lawsuit filed with the Southern District of California on Monday.
According to the complaint, the plaintiff's used 2010 Ferrari ( RACE ) 458 Italia exhibited brake issues resulting in "partial or total loss" of braking function. Nechev claimed that he reported the problem to a Ferrari ( RACE ) dealer in 2021 and was told that the issue was "normal."
The lawsuit contends that Ferrari's ( RACE ) recalls in 2021 and 2022 only provided temporary fixes for identified brake problems, which pose a "dangerous safety risk" to drivers.
The complaint also names Robert Bosch GmbH, the alleged manufacturer of the brake components, as a defendant.
"Ferrari SpA and Bosch GmbH together, designed, developed, and tested the braking systems and the Defective Master Cylinder/Brake Booster Assembly in the Class Vehicles," according to the complaint.
Ferrari ( RACE ) and Bosch did not immediately respond to requests for comment from MT Newswires.
