07:13 AM EDT, 07/02/2025 (MT Newswires) -- Ferrari (RACE) on Wednesday won an appeal at the EU General Court, retaining its rights to the Testarossa trademark.
"The use of the trade mark to guarantee the identity of the origin of the goods for which it was registered, when reselling second-hand goods is capable of constituting genuine use," the court said.
The latest decision overturns prior judgements by the European Union Intellectual Property Office that sought to revoke the mark.
The court ruled that Ferrari made genuine use of the mark between 2010 and 2015, primarily through authorized dealers reselling second-hand vehicles and offering certification of authenticity.
The court determined that the trademark continued to serve its essential function of indicating the origin of the goods.
