Former SC judge AK Ganguly says Dushyant Dave's letter highlights a disturbing trend at Supreme Court

Former Supreme Court judge Justice (retd) Ashok Kumar Ganguly on Friday said the former president of Supreme Court Bar Association Dushyant Dave's letter to Chief Justice of India Ranjan Gogoi highlighted a disturbing trend at the Supreme Court.

Dave alleged that two cases involving Adani Group companies were listed out of turn by the Supreme Court during the summer vacation and disposed of in contravention to the settled practice and procedure. He lashed out at the 'inappropriate' listing of the two Adani cases by the CJI before the bench of Justice Arun Mishra during the vacation.

In an interview to CNBC-TV18's Shereen Bhan, Ganguly said, "Justice administration in any court must be by the board and it must be done is such a fashion as to rule out any amount of suspicion in the mind of the litigant public or the common man. Justice must not only be done, but it must also be demonstrably seen to be done as well. "

Ganguly said, "The letter discloses such particulars which will make any man of ordinary prudence unhappy and will make him very serious concern about the faith of the institution. I am talking about the two cases on which there have been quite serious allegations made with some particulars."

He further added, "I am not blaming anybody. What step the honourable Chief Justice will take I can’t advise him, but he can take something which will restore confidence in the mind of the people."
