General Motors Must Face Class Action Over Faulty Transmissions, Federal Court Rules

06:56 AM EDT, 08/30/2024 (MT Newswires) -- General Motors ( GM ) must face a class action across 26 states alleging it knowingly sold several hundred thousand vehicles with faulty transmissions, a Federal appeals court ruled in a decision filed Wednesday.

General Motors ( GM ) had appealed against class certification, which was granted by a lower court on Mar. 20, 2023, saying most members class members never experienced problems and had no grounds to sue.

But the Sixth US Circuit Court of Appeals affirmed class certification, ruling that a Michigan court acted properly to allow drivers to sue the automobile giant over eight-speed automatic transmissions installed in 2015 to 2019 Cadillac, Chevrolet, and GMC models.

"We hold that the plaintiffs have standing and that the district court did not abuse its discretion in certifying the class action and affirm the class certification," the appeals court said.

General Motors ( GM ) did not immediately reply to MT Newswires' request for comment.
