04:18 PM EST, 11/27/2024 (MT Newswires) -- Alphabet's (GOOG) Google ( GOOG ) unit is asking a federal appeals court to dismiss an antitrust ruling from a case brought by Epic Games, according to a court filing from Google ( GOOG ).
The company said that the previous decision by US District Judge James Donato was flawed and wants the court to overturn the outcome of the long-running lawsuit.
Google ( GOOG ) stated that holding a jury trial instead of a judge's decision on Google's ( GOOG ) actions had an impact on the decision and says the ruling would force it to work with rival app stores, which it contends it is not legally required to do, according to the filing.
Google ( GOOG ) claims that Epic Games is trying to use the courts to reshape Google's ( GOOG ) app store operations, affecting millions of other parties.
Donato has temporarily put his ruling on hold, Bloomberg reported earlier.
The Ninth Circuit Court of Appeals can extend this delay during Google's ( GOOG ) appeal or require Google ( GOOG ) to make changes while the appeal is ongoing, with oral arguments scheduled for Feb. 3, according to the media outlet.
