Imperial Metals Says Xatsull Nation Appeals Dismissal of Mount Polley TSF Petition

07:40 AM EDT, 09/04/2025 (MT Newswires) -- Imperial Metals ( IPMLF ) said late Wednesday the Xatsull First Nation has filed a notice of appeal seeking to overturn Justice Michael Tammen's Aug. 6 ruling that dismissed its petition for judicial review of two provincial approvals.

The approvals, granted in March, authorized construction of a four-meter lift on the tailings storage facility (TSF) at the company's Mount Polley mine. The petition related to raising the TSF to 974 meters.

Imperial said the appeal does not involve the order dismissing an injunction application, meaning the company may complete construction of the TSF raise and continue normal operations at Mount Polley under its existing authorizations.

Imperial shares closed at C$5.05 on the Toronto Stock Exchange Wednesday, up $0.23.
