11:19 AM EDT, 05/14/2024 (MT Newswires) -- Insulet ( PODD ) shares were advancing by 5.7% in recent Tuesday trading despite short-seller Blue Orca Capital saying it had taken a short position on the stock.

The firm alleged in a report that Insulet ( PODD ) has failed to disclose material information about an appellate court's recent decision to "kill" a preliminary injunction against EOFlow. Blue Orca said the court decision "clears the path for Medtronic (MDT) to acquire EOFlow and shatters Insulet's ( PODD ) US monopoly on tubeless automated insulin delivery systems."

Insulet ( PODD ) and Medtronic did not immediately reply to MT Newswires' request for comment. EOFlow could not be reached.
