01:50 PM EDT, 06/13/2024 (MT Newswires) -- Liberty Mutual Fire Insurance's, which was sued by United Rentals ( URI ) , request to remove a federal judge from an insurance dispute was denied, according to a court filing.
The Liberty Mutual Insurance unit requested that Judge Stanley R. Chesler recuse himself from the case as he is a Liberty Mutual policyholder.
Chesler denied the request saying that "this attack is based on information which Liberty Mutual had in its possession and could have acted on at any time in this litigation, but only chose to do so now after it was dissatisfied with the result of a dispositive
motion."
The insurer's motion is based on a premise that is untenable. If judges, who are policyholders, were to recuse themselves from cases, it would "render hundreds, if not thousands, of judges incapable of presiding over large swaths of their dockets," the filing said.
United Rentals ( URI ) has sued Liberty Mutual Fire Insurance for coverage in a lawsuit over a construction accident.
Liberty Mutual declined to comment and United Rentals ( URI ) didn't immediately respond to requests for comment by MT Newswires.
