Aug 28 (Reuters) - Kimberly-Clark Corp ( KMB ) has

agreed to pay up to $40.4 million to resolve a criminal charge

relating to the company's sale of adulterated MicroCool surgical

gowns, the U.S. Justice Department said on Thursday.
