04:02 PM EDT, 08/19/2024 (MT Newswires) -- Kroger ( KR ) said Monday that it filed a motion for a preliminary injunction against the Federal Trade Commission's administrative proceeding opposing its merger with Albertsons ( ACI ) .

The motion submitted in the US District Court for the Southern District of Ohio alleges the FTC's administrative proceeding and a motion in federal court to block the transaction violates its constitutional protections.

The trial for FTC's motion in the District of Oregon will begin on Aug. 26, according to Kroger ( KR ).

FTC did not immediately reply to a request for comment from MT Newswires.
