01:11 PM EDT, 09/19/2024 (MT Newswires) -- Live Nation Entertainment ( LYV ) is seeking dismissal of one of the main claims of the US Department of Justice in its antitrust lawsuit, the company told MT Newswires Thursday.
The company said it filed with the US District Court in Manhattan a motion to dismiss the claim, which challenges as "tying" the industry practice of a promoter who owns or operates a venue promoting all shows at the venue.
"This practice is not unique to Live Nation and is employed by other promoters," the company told MT Newswires. "Ultimately, the DOJ's lawsuit won't solve the issues fans care about relating to ticket prices, service fees, and access to in-demand shows."
In May, the DOJ and several states sued Live Nation and its Ticketmaster unit for alleged anticompetitive conduct.
In the motion officially filed on Wednesday by Live Nation, the company also sought to dismiss the damage claims sought by states, saying they don't have antitrust standing to pursue such damages.
The DOJ didn't immediately respond to a request for comment from MT Newswires.
