02:10 PM EDT, 05/06/2025 (MT Newswires) -- Restaurant Brands International's (QSR) Burger King will have to face a lawsuit accusing it of misleading customers with ads that make its burgers look larger than they really are, Reuters reported Tuesday, citing court proceedings.
The decision, issued by Judge Roy Altman in Miami, reportedly said some consumers could reasonably believe the ads were deceptive.
Nineteen customers from 13 states claim the chain exaggerated the size of most of its menu items in-store and online, with the size of the Whopper shown 35% bigger in ads, with more than twice the amount of meat actually used, the media outlet reported.
Burger King argued that food in its ads is styled to look more appealing, which is common and expected by consumers, but the judge said the company's marketing goes beyond standard exaggeration, especially in ads after 2017, according to Reuters.
A lawyer for the customers reportedly welcomed the judge's decision to allow the case to move forward.
"The plaintiffs' claims are false," a Burger King spokesperson said in an emailed statement to MT Newswires. "The flame-grilled beef patties portrayed in our advertising are the same patties used in the millions of burgers we serve to guests across the U.S."
Restaurant Brands International did not immediately respond to a request for a comment from MT Newswires.
