12:25 PM EDT, 08/21/2024 (MT Newswires) -- Neonode ( NEON ) shares rose 43% intraday Wednesday after its patent lawsuit over Samsung Electronics touchscreen was revived by the US Court of Appeals for the Federal Circuit, according to a court document.

The company had sued Samsung for infringement of a US patent and the District Court for the Western District of Texas had concluded that Neonode's ( NEON ) claim 1 of the patent was invalid as indefinite, the document showed.

The appeals court said on Tuesday it disagreed with the district court's conclusion and "reversed and remanded" it.

"We have considered Samsung's remaining arguments and find them unpersuasive. The district court erred in concluding that the 'wherein the representation consists of only one option for activating the function' language renders claim 1 indefinite," the appeals court ruled.

Samsung Electronics did not immediately reply to MT Newswires' request for comment.
