02:03 PM EDT, 09/05/2025 (MT Newswires) -- An antitrust lawsuit filed by Newmax's (NMAX) broadcasting unit against Fox (FOX, FOXA) and Fox News Network was dismissed on Thursday by a federal judge in Florida, who wrote in the order that Newsmax Broadcasting can resubmit an amended version.
The lawsuit alleged that Fox exploited its market dominance by coercing distributors into unfair carriage agreements that exclude or marginalize competitors, according to Newsmax's ( NMAX ) Wednesday statement.
The tactics included no-carry provisions and confidential clauses that limit Newsmax's ( NMAX ) placement on basic packages, resulting in inflated carriage fees, reduced consumer choice, and delayed growth, according to the lawsuit.
Responding to a request for comment from MT Newswires, a Fox spokesperson referred to a Wednesday statement from FOX News Media, which stated that "Newsmax ( NMAX ) cannot sue their way out of their own competitive failures in the marketplace to chase headlines simply because they can't attract viewers."
