Nike Faces Equal Employment Opportunity Commission Subpoena Enforcement Over DEI Programs

02:33 PM EST, 02/04/2026 (MT Newswires) -- Nike ( NKE ) is subject to a federal court action after the US Equal Employment Opportunity Commission, or EEOC, said Wednesday it filed to compel the company to provide information on alleged discrimination against white workers under its 2025 diversity, equity, and inclusion targets and other DEI initiatives.

The federal agency is investigating allegations that Nike ( NKE ) engaged in intentional race discrimination against white employees in hiring, promotions, demotions, layoffs, mentoring and leadership development programs.

The subpoena seeks information dating back to 2018, including the criteria used for layoffs and the use of employee race and ethnicity data. It also requests details on programs alleged to provide race-restricted career development opportunities.

The EEOC filed the enforcement action in the US District Court for the Eastern District of Missouri after Nike ( NKE ) did not fully comply with the original subpoena requests.

Shares of Nike ( NKE ) were up nearly 4% in recent trading.
