PepsiCo, Frito-Lay Sued by Independent Convenience Stores for Alleged Price Discrimination

12:43 PM EST, 02/18/2025 (MT Newswires) -- PepsiCo ( PEP ) and its subsidiary Frito-Lay North America have been accused of charging independent convenience stores higher net prices for snack brands compared with what they charge grocery chains.

Alqosh Enterprises and NMRM filed a lawsuit Monday alleging that Frito-Lay violated the Robinson-Patman Act by giving lower prices to chain grocery stores such as Walmart and Target for snack chip brands such as Doritos, giving them an unjust advantage over independent convenience stores.

According to the complaint filed in the US District Court for the Central District Court of California, independently-owned California convenience stores have lost "tens of millions of dollars" in the past four years due to the alleged price discrimination.

The plaintiffs are targeting to recover the damages and to obtain a injunction that bars further price discrimination, the complaint said.
