11:48 AM EDT, 11/01/2024 (MT Newswires) -- PepsiCo ( PEP ) won the dismissal of a New York lawsuit accusing the company of polluting the Buffalo River with its single-use plastic packaging, the company said Friday.

In a decision handed down Thursday, Justice Emilio Colaiacovo of the New York State Supreme Court said the company did not not pollute the river and criticized the state's attorney general, Letitia James, for initiating the legal action, according to media reports.

"PepsiCo ( PEP ) is pleased with the court's ruling in favor of our motion to dismiss the New York Attorney General's case. We believe that our time, attention and resources -- and those of other key stakeholders -- are best directed toward collaborative solutions," the company said in a statement to MT Newswires.

PepsiCo ( PEP ) vowed to continue collaborating with key partners on reducing plastic waste and recycling.
