05:10 PM EDT, 04/10/2024 (MT Newswires) -- Procter & Gamble's ( PG ) motion to dismiss a class action lawsuit claiming an alleged marketing deception over the honey content of DayQui and NyQuil cold and flu medicine was partly denied, according to a court filing.

Judge Jeffrey White of the US District Court for the Northern District of California Tuesday allowed one claim by the plaintiff Mark Tobin. The claim on California's Consumer Legal Remedies Act violations remained "because the claim is not preempted and plaintiff plausibly alleges that a reasonable consumer would be misled by the representations," White said.

The plaintiff may file an amended pleading by May 1, according to the filing.

Procter & Gamble ( PG ) did not respond to a request for comment by MT Newswires.
