Provision in Bill to Impose Tax on Foreign Individuals, Companies in US Provides Trump With Retaliatory Power

08:18 AM EDT, 05/30/2025 (MT Newswires) -- US President Donald Trump would have the power to take action against nations that impose special digital service taxes on US tech giants, under the Enforcement of Remedies Against Unfair Foreign Taxes provision in the tax bill headed to the Senate, multiple media outlets reported.

The US House of Representatives narrowly passed the 1,100-page tax bill on May 22, and the Senate is now considering it, the reports said.

"If foreign countries want to come into the United States and tax US businesses, then those foreign-based businesses should be taxed as well," Reuters quoted Ron Estes, a Republican from Kansas, as saying in a statement.

About 17 countries in Europe and others globally have imposed or announced taxes on US tech companies, including Meta Platforms' ( META ) Instagram, while Germany is also considering a 10% tax on platforms like Alphabet's (GOOG, GOOGL) Google ( GOOG ), according to Reuters.

If the Senate passes the bill, the Trump administration will be able to raise taxes on foreign residents and companies that operate in the US, Reuters said, adding that the president has been pressuring foreign nations to reduce barriers to US commerce.

The provision may raise $116 billion over the next 10 years, Reuters reported, citing the Joint Committee on Taxation.
