12:43 PM EDT, 07/19/2024 (MT Newswires) -- Travelers (TRV) unit Northfield Insurance filed a lawsuit against Markel Group ( MKL ) subsidiary State National Insurance to recover legal costs paid on behalf of pharmaceutical wholesaler Scripts Wholesale.
In a complaint filed in the US District Court for the Eastern District of New York on Thursday, Northfield Insurance claimed that the costs related to underlying litigations over counterfeit HIV medication should have been covered by State National.
The complaint involves lawsuits filed by Gilead Sciences ( GILD ) and Johnson & Johnson ( JNJ ) against Scripts Wholesale for allegedly selling counterfeit HIV medication.
Northfield stated in the complaint that it paid for defense and indemnity costs in both lawsuits, while State National only partially covered indemnity expenses in the Gilead case. Northfield has sought reimbursement with interest for its payments covering Scripts' defense and indemnity costs.
State National didn't immediately respond to a request for comment.
Travelers shares fell 7% in recent trading.
