UnitedHealth Patients Petition Appeals Court to Rehear Cross-Plan Billing Case

09:17 AM EDT, 07/23/2024 (MT Newswires) -- Rebecca Smith and Cristine Ghanim petitioned the US Court of Appeals for the Eight Circuit on Monday to rehear their class action suit against UnitedHealth Group ( UNH ) after it affirmed a district court's decision to dismiss the case on July 8.

The class action alleges UnitedHealth ( UNH ) did not pay the plaintiffs' providers in full, but instead offset the amounts due based on sums it claimed the providers had previously been overpaid. Smith and Ghanim claim this policy violates the Employee Retirement Income Security Act of 1974.

"In issuing its decision, the Panel ignored the central argument made by Appellants and decided the case in a manner that conflicts with existing Eighth Circuit precedent, and with decisions of the Supreme Court and other United States Courts of Appeals," the petition said.
