02:07 PM EDT, 09/30/2024 (MT Newswires) -- Universal Health Services ( UHS ) was down almost 3% intraday Monday, paring a more than 7% slide earlier, after saying the jury in a civil lawsuit awarded $360 million to three victims of sexual harassment by the former medical director of a Universal Health facility near Richmond, Virginia.
Universal was a co-defendant in the suit, which was consolidated after separate accusations by three plaintiffs asserting claims of negligence, false imprisonment and violations of the Virginia Consumer Protection Act. The case also makes claims against Dr. Daniel Davidow, who was the medical director at the company's Cumberland Hospital for Children and Adolescents in New Kent, Virginia.
Universal said it already has filed post-trial motions and is evaluating other legal options to challenge the jury verdict from Friday, which awarded $60 million in liability claims against Cumberland and Davidow as well as $120 million in punitive damages and $180 million for trebled damages under the state's consumer protection act. There are about 40 other plaintiffs who have made similar allegations about Davidow, Universal said in a regulatory filing on Monday.
Jury verdict follows a similar case in March that found the company liable in a sexual assault of a minor patient at a Univeral facility in central Illinois and issued an award totaling $535 million in compensatory and punitive damages. The company in August argued several post-trial motions in that case and said it may pursue an appeal depending on how the trial court rules on those motions.
