Alphabet's (GOOG, GOOGL) Google ( GOOG ) suffered a setback after the European Court of Justice's advocate general recommended that the court dismiss the tech giant's appeal to overturn an antitrust fine of 4.12 billion euros ($4.75 billion), the Court of Justice said Thursday.
Advocate General Juliane Kokott proposed that the court confirm the fine set by the General Court in 2018 and reduced in 2022, saying the legal arguments presented by Google ( GOOG ) were "ineffective."
The advocate general's opinion is not binding on the court, but judges mostly tend to follow such opinions, multiple news outlets reported.
"Android has created more choice for everyone and supports thousands of successful businesses in Europe and around the world," Google's ( GOOG ) spokesperson told MT Newswires, adding that if the Court follows the Opinion, it could discourage investment in open platforms and negatively impact Android users, partners, and app developers.
