07:57 AM EDT, 10/08/2024 (MT Newswires) -- (Updates with comment from the FTC's spokesperson in the third paragraph and Amazon's ( AMZN ) spokesperson in the fourth and fifth paragraphs.)
Amazon.com's ( AMZN ) motion to dismiss an antitrust lawsuit brought by the Federal Trade Commission and several states was denied in part and granted in part by US District Judge John Chun in Seattle, court documents revealed Monday.
Chun denied Amazon's ( AMZN ) motion to dismiss claims under the Sherman Act and the FTC Act, granted in part and denied in part dismissal of state-law claims and granted a motion to bifurcate.
"We are pleased with the court's decision and look forward to moving this case forward," said Douglas Farrar, an FTC spokesperson, in an email to MT Newswires. "The ways Amazon ( AMZN ) illegally maintains its monopolies and the harm they cause -- including suppressed competition and higher prices for shoppers and sellers -- will be on full display at the trial. This case ultimately seeks to pry loose Amazon's ( AMZN ) monopolistic control and restore competition."
Tim Doyle, an Amazon ( AMZN ) spokesman, told MT Newswires that the FTC's claims about how consumers shop on Walmart (WMT), Target (TGT), Amazon ( AMZN ), and eBay (EBAY) for household products is not consistent with how they actually shop.
"The truth is that Amazon's ( AMZN ) practices are good for competition, consumers, and the small- and medium-sized businesses that sell in our store, while the FTC's approach would make shopping more difficult and costly," Doyle said.
