11:27 AM EDT, 07/30/2024 (MT Newswires) -- US Court of Appeals for the Fifth Circuit granted a motion for the stay of a new rule by the US Transportation Department on upfront disclosure of airline fees pending a review of the regulation.
Delta Air Lines ( DAL ) , United Airlines (UAL), American Airlines ( AAL ) , JetBlue Airways ( JBLU ) , Alaska Airlines (ALK), Hawaiian Airlines (HA), the trade group Airlines for America, the National Air Carrier Association and the International Air Transport Association were among the airlines and groups that sued to block the rule.
The rule, which mandates airlines and ticket agents to disclose service fees along with the airfare, "likely exceeds DOT's authority and will irreparably harm airlines," according to the ruling by a three-judge panel.
The ruling also expedited the petition to the next available oral argument panel.
"DOT will continue defending our rule that protects consumers from surprise fees that can unexpectedly jack up the price of air travel," a department spokesperson told MT Newswires in an email. "Nothing in the court's decision prevents airlines from voluntarily complying with this common sense rule that simply requires them to keep their customers fully informed when buying a plane ticket."
United and American referred requests for comment to Airlines for America. Delta Air Lines ( DAL ), JetBlue Airways ( JBLU ), Alaska Airlines, Hawaiian Airlines, National Air Carrier Association and International Air Transport Association did not immediately respond to requests for comment.
