After the Supreme Court (SC) verdict on Aadhaar being constitutionally valid, the government has proposed that children have the option of cancellation of the 12 digit biometric identifier within a period of six months of attaining 18 years of age.

The consent of a parent or guardian will be must for enrolling a child, while no child will be denied any subsidy, benefits or services for lack of Aadhaar, as per the proposed changes.

In the September verdict, a judgement based on the above amendment had not been passed.

The document, stating the amendments pointed that details of Aadhaar can only be voluntary in 'physical or electronic form by authentication or offline verification or any other mode which may be notified by the centre'.

The SC had also ruled that Section 57, the norm which let private companies insist on Aadhaar details of citizens, unconstitutional. The amendment document confirmed that section 57 of the Aadhaar Act will be omitted.

Among the amendments, the authority can permit the entities performing the Aadhaar authentication only if they are compliant with the standards of privacy and security specified. The document also said the authentication of offline Aadhaar verification can only be performed after the consent of the holder.

An establishment of Unique Identification Authority of India Fund has also been ordered. The use of the Aadhaar number will only be on a voluntary basis as acceptable in the KYC document under the Telegraph Act, 1885 and the Prevention of Money-laundering Act, 2002, the document said.

On the Aadhaar data, the amendments said that it will enhance the restrictions on sharing the information by roping in the entity and offline verification-seeking entity.

If there are any illegal activities related to the act, the authority will charge with 'civil penalties, its adjudication, appeal thereof and realisation

of the sum of penalty as arrear of land revenue'.

The government has proposed a penalty of up to Rs 1 crore on entities that violate the provisions of the Aadhaar Act, with an additional fine of up to Rs 10 lakh per day in case of continuous non-compliance, sources had told PTI.

The proposed amendments also make provision for 'Virtual ID' and voluntary and offline modes of using Aadhaar. A bill to amend the Aadhaar Act, the Indian Telegraph Act and the Prevention of Money Laundering Act is listed for introduction in the Lok Sabha on Wednesday, the PTI report said.
