Amazon's ( AMZN ) attempt to get a court to reject its designation by European regulators as a "very large online platform" was rejected Wednesday by a top European court.
The European Commission designated Amazon ( AMZN ) an exceptionally large platform of more than 45 million users with special antitrust restrictions and obligations under the European Union's Digital Services Act, a categorization Amazon ( AMZN ) sought to annul, the Court of Justice of the European Union said in a statement.
The court said that while the designation limited Amazon's ( AMZN ) freedoms, the interference was lawful and justified in accord with the EU's Charter of Fundamental Rights.
Amazon ( AMZN ) said in an email to MT Newswires that it was disappointed by the ruling and intends to appeal.
"The Very Large Online Platform status of the DSA was designed to address systemic risks posed by very large companies with advertising as their primary revenue and that distribute speech and information," the company said. "The Amazon Store, as an online marketplace, does not pose any such systemic risks; it only sells goods, and it doesn't disseminate or amplify information, views or opinions."
