05:28 AM EST, 11/14/2025 (MT Newswires) -- BHP (BHP) has been judged partially responsible for the 2015 disaster at the Fundao dam in Brazil, a UK court said in a summary of its ruling issued Friday.
Damages will be assessed at later court sessions to be completed in 2028 and 2029, the court and the company said.
The court ruled that BHP's control of the dam and participation in dam operations as a joint venture partner "gave rise to a legal duty to avoid harm caused by any act or omission that was negligent, imprudent or lacking in skill" and that the company knew or should have known of problems at the dam by 2014.
BHP said it plans to appeal the decision.
The company said it has already entered into a $32 billion agreement with Brazilian authorities for a full and final settlement in connection with the dam failure, with more than 610,000 people already compensated.
Shares of the company were down 1.7% in recent premarket activity.
