Meta Platforms' Request to Delay Privacy Case Reopening Rejected by US Appeals Court

09:01 AM EDT, 04/01/2024 (MT Newswires) -- Meta Platforms ( META ) cannot stop the US Federal Trade Commission from reopening an investigation into Facebook privacy practices, while the company challenges FTC's authority through a lawsuit, a US appeals court said in a ruling Friday.

The US Court of Appeals for the D.C. Circuit said in the ruling that Meta "has not satisfied the stringent requirements for an injunction pending appeal."

The court said the five constitutional challenges that Meta presented have no likelihood of success "given binding precedent and the unusual record before us." It added that Meta also failed to show that it would suffer irreparable harm.

"Meta's failure to show a likelihood of success on this appeal or irreparable injury tips the balance of equities and the public interest against an injunction," the court order stated.

Meta and FTC did not immediately reply to MT Newswires' requests for comment.
