10:29 AM EDT, 07/01/2024 (MT Newswires) -- The US Supreme Court on Monday ruled that a North Dakota convenience store and truck stop can sue over a 2011 rule dictating the charges that financial institutions can impose on merchants, overturning a ruling by a US District Court that was affirmed by the US Court of Appeals for the Eighth Circuit.
The suit was dismissed by the District Court as time-barred under the default six-year statue of limitations in suits against the US. However, the Supreme Court majority ruled that since the business did not open until 2018 and it filed its suit within six years of its injury, it is allowed to proceed.
