Amazon.com ( AMZN ) filed a federal lawsuit against the New York State Public Employment Relations Board Monday, aimed at blocking the enforcement of a new state law that the online retail giant deems "unconstitutional".
The company said the Senate Bill 8034A, or the SERA amendment, allows the New York State Public Employment Relations Board, or PERB, to regulate private-sector labor relations already governed "exclusively" by federal law under the National Labor Relations Act.
"The SERA Amendment is unconstitutional. It intrudes on and seeks to displace exclusive federal authority," Amazon ( AMZN ) said.
Amazon ( AMZN ) added that the PERB has already undertaken a "power grab" and taken advantage of the new law by filing charges against the company for firing an employee at one of its warehouses, while the dispute was already pending before the National Labor Relations Board.
PERB does not comment on any pending litigation, it said in an emailed response to MT Newswires.
