A federal judge granted Southwest Airlines' ( LUV ) motion to dismiss a class action complaint stemming from 16,000 canceled flights between Dec. 22, 2022, and Jan. 2, 2023, allegedly caused by a combination of outdated software and winter storms.
The consolidated class actions alleged that the airline violated its contract with passengers by failing to rebook or refund canceled flights during the period, according to a ruling Tuesday by the US District Court for the Southern District of California.
The airline contended that its contract of carriage required the customers to explicitly request a rebooking or refund, and none of the plaintiffs had made such a request. Judge Anthony J. Battaglia ruled to dismiss the claim saying the customers did not address Southwest Airlines' ( LUV ) argument.
Battaglia also dismissed the bailment claim by the passengers, noting they failed to meet the notice conditions required for a contractual bailment claim..
The passengers can file an amended complaint by June 21.
Southwest Airlines ( LUV ) did not immediately respond to MT Newswires' request for comment.
