A federal judge in California granted in part Apple's ( AAPL ) motion to dismiss a lawsuit against it, which accused the technology giant of improper collection and use of mobile device users' data.
Judge Edward Davila for the Northern District of California dismissed almost all of the claims based on the "Allow Apps to Request to Track" setting, while letting some claims proceed over the "Share [Device] Analytics" setting.
The iPhone maker "sufficiently disclosed the challenged data collection in both the Privacy Policy and then subsequently in the welcome screen disclosures," Davila said in in a 39-page decision issued late Thursday. He added that the complainants' consented to the data collection.
"Plaintiffs do not explain why a reasonable person, reading the statements in the 'Allow Apps to Request to Track' setting, would believe that turning the setting off would withdraw their consent to Apple's ( AAPL ) collection of data from Apple Apps," Davila said.
The court dismissed the complainants' claims of "breach of implied contract and unjust enrichment" and invasion of privacy, among other claims.
Apple ( AAPL ) did not immediately respond to a request for comment from MT Newswires Friday.
